The NCAA isn't going to receive immunity from lawsuits. Even if Congress passed something along those lines, the Supreme Court would strike it down because the SC has already said they won't entertain giving the NCAA an anti-trust exemption. Now, having said that, there's nothing in the Constitution that says you can't have a monopoly or trust in late nineteenth century parlance. What needs to happen for some kind of congressional help to occur is some kind of governing entity needs to incorporate market principles into their "rules." Given the NCAA's tainted record, I can't see this legally happening. You need a break away from the NCAA and fresh start.

The CSC is not truly independent of the NCAA. They were established by the NCAA to serve an NCAA function. The CSC won't exist much longer because it's a stupid concept. You can't legally tell someone how much a marketing deal is worth. We said as much when this nonsense started last year. If you want to get a "handle" on collegiate athlete compensation, you must negotiate a deal with them. Contrary to uninformed sportscaster opinions, this does not necessitate collective bargaining. There are literally millions of examples of controlled pay structures that don't have collective bargaining.

The Spurs are 38-3 in games that Wemby plays at least fifteen minutes, and yet he wasn't MVP. The NBA has a long and notorious history of giving MVP to the wrong guy.
